The spirit of the AUP is to ensure customers are using's services with due regard to the rights of other Internet users and in conformity with the requirements of's network environment. The AUP are not exhaustive and reserves the right to add, delete, or modify any provision of its AUP at any time without notice, effective upon posting of the modified AUP to our site. Server Resources Any web site that uses a high amount of server resources (such as, but not limited to, CPU time, memory usage, and network resources) will be given the option to either pay additional fees (which will depend on the resources required), reduce the resources used to an acceptable level, or upgrade its service to a virtual private server. will be the sole arbiter of what is considered to be a high server usage level. Any Web Hosting and E-Commerce account deemed to be adversely affecting server performance or network integrity will be shut down without prior notice. CGI Scripts Any scripts that pose a potential security risk or are deemed to be adversely affecting server performance or network integrity will be shut down or will be automatically removed without prior notice. does not permit CGI script sharing with domains not hosted by Chat Rooms does not allow Web Hosting and E-Commerce customers to install their own chat rooms. Chat rooms tend to require significant system resources and therefore cannot be permitted as an account option. Background Running Jobs and Cron Jobs may allow ad-hoc programs to run in the background. These programs will be considered on an individual basis and acceptance is not guaranteed. However, most of control panels allow scheduled tasks or cron jobs to be created. IRC does not allow IRC or IRC bots to be operated by Web Hosting and E-Commerce customers. Services's services include, but are not limited to:

  1. any act of preparing, setting up, connecting, maintaining, terminating, or reconnecting customers' account (including all billing data and the space on the particular Web server that provides to customers);
  2. any use by customers, or any access provided to customers by, of computing, telecommunications, software, information, hardware, and equipment;
  3. any act, or provision of any service, by to customers, related to web hosting and domain name registrations (including server usage and technical support), regardless of duration and whether paid for or not;
  4. any provision by to customers, of any space, Internet connectivity, or electrical power;
  5. any access or use related to the's web site, including the web site itself;
  6. any other service mentioned in this policy;
  7. any other service provided by to customers, whether used or not;
  8. any other services that are used by customers, whether offered or provided by to customers.
Ownership of Website The legal owner of customers' web sites and accounts with will be the individual or organization whose name is listed in's database as the owner. Customers will fully cooperate with and abide by any and all of's security measures and procedures in the event of any dispute over ownership of customers' web sites and accounts with Accepting Payments on your Website The Payment Card Industry Data Security Standard (PCI DSS) is an information security standard for organizations that handle card holder information for debit, credit or other payment cards. Our Website Hosting and Reseller Hosting service does not comply with PCI DSS due to the nature of a shared hosting environment (many users and websites sharing resources). You are not permitted to store and manage card details on Website Hosting and Reseller Hosting. Any website found storing card details will be suspended. Please note that we recommend using third-party payment processing gateways (e.g. paypal, worldpay or 2checkout) as payments are handled and stored by each third-party merchant respectively. Cost of hosting All resellers must charge for costs of hosting, we do not allow FREE hosting to be hosted on our servers. Anyone who is offering free hosting on their websites will be asked to remove this, or be suspended from our reseller services. Illegal Use servers may be used for lawful purposes only. Transmission, storage, or distribution of any information, data, or material in violation of any applicable law or regulation, or that may directly facilitate the violation of any particular law or regulation is prohibited. This includes, but is not limited to: copyrighted material; trademarks; trade secrets or other intellectual property rights used without proper authorization; material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws. Additionally, in purchasing services, all customers certify that they and/or the organization they represent in procuring services from are not, nor have been designated, a suspected terrorist; are not owned or controlled by a 'suspected terrorist'; and are not on, are not a member of, related to, associated with, or controlled by any organizations on the list contained in the Annex to Executive Order 13224 and all updates thereto. also does not permit any service that can be used to facilitate illegal use or activity, such as torrent, Waraz or other file sharing services nor any illegal content nor content that maybe found harmful towards other people. Email Services As a part of shared and reseller hosting, we offer all clients a mail server. The max emails that can be sent out in any single hour are 300 per domain. For windows hosting customers, all emails from deleted items will be deleted after 15 days, Sent Items after 30 days, inbox after 60 days and spam folder after 7 days. However these default settings can be changed. The maximum number of mailboxes that can be created on a single domain name is 150 mailboxes. Each email sent must have 50 or less recipients. The total email allowance per domain name is 1024MB. This means all mailboxes together must not exceed 1024MB; however we can increase this to 2048MB if proven more space is required. This is on a per domain basis. Spamming Sending unsolicited bulk and/or commercial messages over the Internet (known as "spamming") is prohibited, regardless of whether or not it overloads a server or disrupts service to's customers. The term "spamming" also includes, but is not limited to, maintaining an open SMTP policy, engaging in spamming using the service of another ISP or IPP and referencing in the spam a web site hosted on a server, and selling or distributing software (on a web site residing on a server) that facilitates spamming. Violators will be assessed a fine and will face immediate suspension. reserves the right to determine, in its sole and absolute discretion, what constitutes a violation of this provision. Mass Mailing Mass mailing / mailing lists is not allowed on shared hosting servers. A dedicated mass email server can be provided with the use of unlimited SMTP. Anyone who sends mass mail and is found to of caused issues to service or IP reputation will have his or her domain name suspended. Those who are found to be sending masses of spam emails will be given a flat fine of £30.00 to cover administration time for to physically remove the emails from our spool. Any email spam /bulk user that causes IP black listings will be given a fine of £100.00. Any user that causes complaints from other companies, for example spamcop, aol, yahoo etc will be given a fine of £50.00 to cover administration fee's for to advise the companies the reasons why the spam was sent. System and Network Abuse Violations of system or network security are prohibited and may result in criminal and civil liability. Use of services or equipment for creating or sending viruses, worms or Trojan horses, or for pinging, flooding or mail bombing, or engaging in denial of service attacks is prohibited. It is also prohibited for any customer to engage in other activity that is intended to disrupt or interfere with, or that results in the disruption of or interference with, the ability of others to effectively use our services and equipment (or any connected network, system, service or equipment) or conduct their business over the Internet. Examples of system or network security violations include, without limitation the following: unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without express authorization of the owner of the system or network; interference with service to any user, host or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks; forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting. Database Usage / Abuse If your database is found to be abusing our servers (i.e. too many connections causing our servers to go down), your database will immediately be suspended. If your website is not closing database connections and your website causes sleeping connections eventually causing high usage to our database server, then your database will be suspended. Viruses and Other Destructive Activities Use of's services or equipment for creating or sending Internet viruses, worms or Trojan horses, or for pinging, flooding or mail bombing, or engaging in denial of service attacks is prohibited. It is also prohibited for any customer to engage in other activity that is intended to disrupt or interfere with, or that results in the disruption of or interference with, the ability of others to effectively use's services and equipment (or any connected network, system, service or equipment) or conduct their business over the Internet. Virus's Uploaded to Websites If your website contains a virus or a virus has been uploaded by the website owner or if the website is hacked in anyway, our system will automatically attempt to clean the virus. If this does not happen, our system will then attempt to delete the virus. If the virus cannot be deleted and several viruses are uploaded your domain name will be suspended from our hosting. You would then need to pay an administration fee of £10.00 to have the domain name re-enabled. Adult Content Some adult content is allowed. For instance, we allow nudity; however pornographic images, videos and pornographic websites are not allowed. Child Pornography The use of's services to store, post, display, transmit, advertise or otherwise make available child pornography is prohibited. is required by law, and will, notify law enforcement agencies when it becomes aware of the presence of child pornography on, or being transmitted through, its services. Privacy is concerned with the privacy of on-line communications and web sites. In general, the Internet is neither more nor less secure than other means of communication, including mail, facsimile, and voice telephone service, all of which can be intercepted and otherwise compromised. As a matter of prudence, however, urges its customers to assume that all of their on-line communications are insecure. cannot take any responsibility for the security of information transmitted over's facilities. Customer Responsibility Customers are required to use the network responsibly. This includes respecting the other customers of reserves the right to suspend and/or cancel service with any customer who uses the network in such a way that adversely affects other customers. While may monitor its service electronically to determine that its facilities are operating satisfactorily, as a general practice, does not monitor its customers' communications or activities to determine whether they are in compliance with the AUP. Violators of the policy are responsible, without limitations, for the cost of labour to rectify any damage done to the operation of the network and business operations supported by the network, and to respond to complaints incurred by Disk Usage Disk usage included with hosting plans includes disk space for databases and email. Limit Over usage If you go over your disk space they will be a charge of £10.00 per 1GB daily fee applied to your account. If you go over your bandwidth allowance they will be a charge of £1.00 per 1GB daily fee applied to your account. Indemnification's customers agree to protect, defend, hold harmless, and indemnify, any third party entity related to (including, without limitation, third party vendors), and's executives, directors, officers, attorneys, managers, employees, consultants, contractors, agents, parent companies, subsidiaries, and co-subsidiaries with the same parent company as, from and against any and all liabilities, losses, costs, judgments, damages, claims, or causes of actions, including, without limitation, any and all legal fees and expenses, arising out of or resulting in any from the customer's use of's services. Disclaimer The service is provided on an as is, as available basis without warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose or non-infringement. expressly disclaims any representation or warranty that the service will be error-free, secure or uninterrupted. No oral advice or written information given by, its employees, licensors or the like, will create a warranty; nor may you rely on any such information or advice. and its partners and suppliers will not be liable for any cost or damage arising either directly or indirectly from any transaction or use of the service. Termination for Bankruptcy or Insolvency If a customer becomes insolvent or any bankruptcy petition is filed by the customer, or any third party against the customer, may immediately terminate provision of's services to the customer without prior notice or penalty. Such customer consents to the grant of relief from any automatic stay of proceedings against in such event. Modifications to Services may discontinue, upgrade, replace, modify, or change in any way, without limitation, any software, application, program, data, hardware, equipment, or portions or components thereof, used to provide customers with's services. Certain changes to's services may affect the operation of customers' personalized applications and content. Each customer is solely responsible, and is not liable, for any and all such personalized applications and content, except as expressly agreed to by Backup of Data We provide backups of all Website Hosting and Reseller Hosting websites and databases solely as a gesture of goodwill. Only emergency backup is made on our mail servers. We recommend you to make regularly your own backups and always make a backup before you upgrade or change your website, meaning you can then recover to a specific point in time from your own backups. Restores from our backups can be made either directly through your control panel or via a support request. Please note that backups from our vault are stored for only up to 10 days only. Aspnethost is NOT RESPONSIBLE for any lost files, databases, web sites, emails or other information. Aspnethosting does not guarantee to have the latest copy of the subscriber's databases, web sites, emails, files, etc in our backups. Third Party Licenses makes a reasonable effort to provide customers with technologies, developments, and innovations (collectively "Technologies"), part of which may be licensed, or co-branded, from or by, third party entities. Third Party Billing System (WHMCS) leases and utilizes a third party billing system (WHMCS) in order to bill and collect payments from their customers, purchase domains on behalf of their customers, renew monthly subscriptions, etc. does not have any responsibility for performance failures of WHMCS to their customers. Products Any mention of products by, its employees, or any third party entity related to is for information purposes only and does not constitute an endorsement or recommendation by disclaims any and all liabilities for any representation or warranty made by the vendors of such products or services. Waiver and Amendment Any waiver, modification, or amendment of any provision of the AUP or other agreement for services, initiated by a customer, will be effective only if accepted in writing and signed by an authorized representative of Independent Contractors Nothing in this Agreement will be construed as creating a partnership or relationship of employer and employee, principal and agent, partnership or joint venture between and its customers. Each of and its customers will be deemed an independent contractor at all times and will have no right or authority to assume or create any obligation on behalf of the other, except as may be expressly provided herein. All Customers Billing Policy The following Terms of Use constitute's Billing Policy and apply to ALL customers: Payments All charges are shown in GBP. If no payment is received during the 45 days suspension following the 3rd reminder, the Customer account including domain, sites and emails will be deleted a day after the 45 day period is over. Billing Cycles (Terms) The Billing Cycle begins on the Plan Activation Date. You may elect to change your Billing Cycle at any time; however, the new Billing Cycle will only take effect at the time of the next plan renewal. Additional items are non-refundable. Account Renewals In order to insure uninterrupted service to your website, all plans will automatically renew at the end of the plan's Billing Cycle. Plan renewal charges are based on the prevailing rate on the date of renewal according to the service selected. Plans are renewed for the same billing cycle. If you wish to cancel your plan before plan renewal, please refer to the Cancellation section below. Statements does not mail paper invoices or statements. Cancellations submitted later than this time may result in automatic renewal of your hosting plan.
